Acceptance of Orders
All orders received are subject to acceptance by The Courtyard Shop Ltd and we reserve the right to reject any order without giving reasons. No contract to supply goods or services to you will come into existence unless we dispatch goods or provide services to the purchaser or otherwise communicate to the purchaser our acceptance of an order.

Alcohol
Gifts containing alcoholic drinks cannot be sold to persons under 18 years of age.

Cancellations
Orders can be cancelled up to the day before despatch, when a full refund will be credited. For online purchases the customer has the right to cancel an order up to seven days after receipt of goods. Where this right is exercised you will be refunded the full amount minus any perishable goods which cannot be resold and any items which have been consumed or damaged as well as carriage charges incurred. All goods must be returned in good condition. We aim to provide the refund within seven days on receipt of returned goods, less any charges as stated above, once the hamper has been returned. Notification of cancellation must be in writing - letter, fax or email. Please see the details below. Cost of return to be paid by the customer.

Contents
A full list of contents is given for each hamper. Photographic props such as glasses, plates, candles, Christmas stocking, flowers and fruit are not included, unless otherwise stated in the list of contents. Items in hampers may be substituted if unavailable at time of despatch. Any substitutions will be of a similar or superior value.

Force Majeure
Whilst every effort will be made to meet customers demands, cancellations or variations may be necessary as a result of an Act of God, War, Strike, Lockout, Labour Dispute, Fire, Flood, Drought or other causes beyond the control of The Courtyard Shop Ltd. If attempted delivery is not made within an acceptable time, then the customer may cancel the order. We suggest that this is over seven days for the UK mainland.

Law
These terms and conditions and all acts of The Courtyard Shop Ltd., its Directors and employees shall be in the accordance of the laws of Scotland. Nothing in these terms and conditions affects your statutory rights.

Payment Terms
We accept payment online by Visa, MasterCard, American Express and Debit Cards. Please fill in your card number, expiry date and 3 or 4 digit security code. Gifts may be ordered and paid for up to three months in advance of delivery to take advantage of discounts or promotional codes.

Privacy Policy
Taymouth Courtyard does not disclose buyers or recipients’ information to third parties, without their prior permission.

Reservation of Title
All goods remain the property of The Courtyard Shop Ltd. until they have been paid for in full.

Security
You can be confident when you enter Your Account with your email address and password, that all your information in the Checkout and Payment area will be fully encrypted using the latest Sage Pay security technology. All data sent to our server and the data returned to you is encrypted to prevent unauthorized persons viewing your details. Gifts containing Christmas items ordered during the rest of the year will automatically have these items substituted unless otherwise requested.

VAT and Duty
These apply at the current rate at the time of invoicing. Some gifts contain zero rated food items. On these items a percentage VAT rate has been calculated.

Delivery Details

Accurate addresses and signature for receipt of gift
Please ensure all addresses are accurate to include postal town and postcode, together with recipient’s telephone number. Inaccurate addresses will inevitably cause delay and incur an additional delivery charge. We are unable to deliver to BFPO and PO Box numbers. Our liability is limited to delivery to the building, not individual recipient

Next Day Delivery
We will always try to dispatch for delivery the next day. This is clearly subject to stock availability. Orders received on a Thursday or Friday, will be posted out during working hours on Monday. We do not send out on these days due to the restrictions on chilled goods. The Scottish Highlands and all offshore islands are a two day service with surcharges as listed below.

Christmas Delivery
We guarantee Christmas delivery to all UK mainland addresses for all orders received up to 6pm on Monday 16th December 2024, providing someone is available to receive the gifts. Any orders received after this date will be subject to availability, which we will confirm. Christmas deliveries will be dispatched on the 9th/10th and 16th/17th December 2024. We do not dispatch on Thursdays, Fridays, Saturdays or Sundays.

We cannot despatch Christmas fresh food such as cheeses before the 9th December 2024. If the recipient is not in when the courier tries to deliver their parcel, it will be left in a safe place and a card will be put through the letterbox stating where the parcel has been left. Responsibility for the item under such circumstances falls directly on the recipient.

Delivery Times

Standard Delivery Times
Deliveries are made between 8am – 5pm Tuesday to Friday (excluding bank holidays). No deliveries will be made on Mondays due to the restrictions on chilled and fresh goods.

Preferred Dispatch Date
You can select a preferred dispatch date up to three months in advance of the current date and we always do our best to deliver your gift by your preferred date. We regret that we are unable to guarantee a day or time of delivery due to scheduling that is outside our control. Timed next day deliveries can be arranged for an additional charge. Collection
Gifts may be collected from our shop by arrangement. Please email and telephone as above to notify.

Prices
Mainland deliveries throughout the UK will all be charged at £9.95 as a flat rate for any parcel up to a weight of 6kg when packed, if the purchase is less than £94.99. Any parcel up to the 6kg weight when packed exceeding or of the value of £95.00 will be sent free of charge, the price of posting being covered by The Courtyard Shop Ltd as a gesture of goodwill to the recipient.

Scottish Western Isles (excluding Outer Hebrides) – 48hr service. All Scottish Western Isles deliveries are surcharged at £18.50 per parcel inclusive of VAT

Other Islands:
Including Eilean Siar (Outer Hebrides), Isle of Anglesey, Isle of Wight, Orkney Islands; Shetland Islands.

All deliveries to these islands are surcharged at £18.50 per parcel inclusive of VAT. Our usual delivery time frame is a 2-5 days service so parcels to these locations will only be dispatched on a Monday or Tuesday.

Overseas - including Channel Islands, Northern Ireland, Europe & Worldwide deliveries:

Unfortunately we are currently unable to send hampers to any of these locations.

Protective packaging
All our food gifts are packed in strong poly boxes to ensure the products remain chilled during transport. Depending on the contents of your gift, we usually pack glass items in bubble wrap and use polystyrene chips or extra bubble wrap to protect your gift in transit.

Insured and tracked
The gifts are dispatched via courier, are insured and tracked.

Non Delivery arrangements:

Recipient not in and no safe place
The driver will leave a card at the address with contact information for re-delivery or collection. Any parcel which has been carded and not delivered or collected within five working days from date of dispatch is automatically returned to Taymouth Courtyard. We cannot be held responsible for any perishable foods if the recipient does not contact the courier immediately on receipt of the calling card.

Claims for loss or damage
Delivery services have significantly improved in recent years, so in the unlikely event of damage or loss in transit, we will replace the damaged contents or gift immediately free of charge providing the following:

  1. The goods are signed for upon receipt as damaged or have been refused because of obvious damage
  2. The courier and ourselves are informed at once and it is confirmed by the recipient to us in writing within a reasonable time of delivery quoting reference number on the parcel. Our couriers recommend that any damage which cannot be seen from the outside must be notified to Parcelforce & Taymouth Courtyard in writing within 7 days.
  3. Damaged goods must be retained for inspection and it may be required that they be returned to us at our expense before replacement or refund.
  4. All claims must be submitted within a reasonable time. Our couriers recommend a maximum of fourteen days.
  5. Returned goods must clearly show the full name, address and telephone number of the sender.
  6. We cannot accept responsibility for the wrong order or non-delivery, resulting from incorrect information or addresses being provided
